MARINE ACT - SECT 96

For the purposes of this Division, a vessel that is, by reason of:

        (a)     the defective condition of a part of the vessel;

        (b)     the improper loading of the vessel;

        (c)     the undermanning of the vessel; or

        (d)     for any other reason,

unfit to proceed on its proposed voyage without danger to human life, is an unsafe ship.
