(1) Where the Supreme Court has appointed a tutor in accordance with section 37, or where a manager with power to conduct legal proceedings has been appointed under section 13 of the Aged and Infirm Persons' Property Act , a putative defendant may serve on the tutor or manager in accordance with this section a notice to proceed.
(2) Where a notice to proceed is served under subsection (1), section 36(1) applies as though the person ceased, on the date of the service of the notice, to be under a disability and does not thereafter come under that disability.
