Arrears of income

22. Arrears of income

(1) Subject to subsections (2) and (3), an action to recover arrears of income is not maintainable after the expiration of a limitation period of 3 years from the date on which the cause of action first accrued to the plaintiff or to a person through whom he claims.

(2) An action to recover arrears of interest on principal money shall not be brought after the expiration of the limitation period fixed by or under this Act for an action between the same parties to recover the principal money.

(3) Subsections (1) and (2) do not apply to an action to which section 28 applies.

(4) The provisions of this section apply to an action to recover arrears of income from any person whether as principal, surety or otherwise.
