Northern Territory Consolidated Acts(1) Where a provision of an Act is expressed to confer power, or to amend a provision of another Act in such a manner that the other Act, as amended, will confer power, to take any action, including power to make an appointment or to make a statutory instrument then, before the first-mentioned provision or the second-mentioned provision as amended, as the case may be, commences, that power may be exercised and anything may be done for the purpose of enabling the exercise of that power or of bringing the appointment or instrument into effect.
(1A) Subsection (1B) applies if a power to appoint a person to an office or to establish an entity is exercised under subsection (1).
(1B) For the purposes mentioned in subsection (1):
(a) the person appointed may act in the office; or
(b) the entity may meet and exercise its powers and perform its functions.
(2) An action taken by virtue of subsection (1), takes effect:
(a) on the day on which the provision first therein mentioned commences; or
(b) on the day on which the action would have taken effect if that provision had been in operation when the action was taken,
whichever is the later day.
