EXPLANATORY STATEMENT


GENERAL OUTLINE

This Bill proposes amendments to the Radiation Protection Act and the Radiographers Act.

The purpose of this Bill is to amend the Radiation Protection Act and the Radiographers Act to allow for the continuation of registration of radiographers in the Northern Territory.


NOTES ON CLAUSES


Part 1 Preliminary

Clause 1. Short title

This is a formal clause, which provides for the citation of the Bill. The Bill, when passed, may be cited as the Radiation Protection and Radiographers Amendment Act 2009.

Clause 2. Commencement

Parts 1 and 2 of this Act commence on the day on which the Act is assented to by the Administrator. Part 3 commences immediately after the Radiation Protection Act 2004 commences. Parts 4 and 5 commence one year after the day section 15 takes effect.


Part 2 Amendment of the Radiation Protection Act

Clause 3. Act amended

This Part amends the Radiation Protection Act.

Clause 4. Amendment of section 89 (Regulations)

This clause provides enhanced regulation-making power in the Radiation Protection Act in relation to the instruments under the Radiographers Act that are deemed to be licences under the Radiation Protection Act.

Clause 5. Amendment of Part 9 (heading)

This section updates the heading for this Part.

Clause 6. Amendment of Part 91 (Definitions)

This section refers to the repeal of the Radiographers Act, which will now continue in an amended form.

Clause 7. Repeal of section 93

This section removes further references to the repeal of the Radiographers Act.

Clause 8. Amendment of Part 9, Division 4 heading

Updates the heading for this Part.

Clause 9. Amendment of section 100 (Registration)

Allows for a person registered as a radiographer prior to the commencement of the Radiation Protection Act to continue to be registered under the Radiographers Act.

Clause 10. Repeal of section 101 (Pending applications for registration and practising certificates)

Removes reference to pending applications, as the Radiographers Board will now continue.


Clause 11. Amendment of section 102

Removes further references to the repeal of the Radiographers Act.

Clause 12. Amendment of section 103

Corrects the consequential reference to a section of the Dangerous Goods Act

Clause 13. Repeal of schedule 2 (Radiographers legislation repealed)

Removes provisions for the repeal of the Radiographers Act, which will continue in an amended form.

Part 3 Amendment of the Radiographers Act

Clause 14. Act amended

This Part amends the Radiographers Act.

Clause 15. Amendment of section 19 (Persons exempted)

Recognises a license granted under the Radiation Protection Act.

Clause 16. Amendment of section 20 (Permit for specific radiographic procedures)

Removes the power to grant a permit for non-radiographers to apply radiographic procedures from the Radiographers Act.

Part 4 Further amendment of the Radiographers Act

Clause 17. Act amended

This Part amends the Radiographers Act.

Clause 18. Amendment of section 11 (Register)

Housekeeping clause, to update requirements for a register for radiographers.



Clause 19. Amendment of section 17 (Appointment of Inspectors)

Removes all users of radiographic procedures who are not radiographers from the requirement of being inspected under the Radiographers Act.

Clause 20. Amendment of section 20 (Permit for specific radiographic procedures)

Removes the requirement to register under the Radiographers Act for all users of radiographic procedures who are not radiographers.

Clause 21. Amendment of section 21 (Record of persons exposed
to radiography)

Removes the requirement to maintain records under the Radiographers Act for all users of radiographic procedures who are not radiographers.

Clause 22. Amendment of section 22A (Annual publication of register)

The register will now only include registered radiographers, not all persons with a permit.

Part 5 Expiry of this Act

This Act expires when all amendments are done.
