ELECTORAL AMENDMENT BILL (NO. 2) 2007


The purpose of this Bill is to amend the Electoral Act to:
· allow for ballot paper position draws to be conducted at sites determined by the Electoral Commission; and
· equalise the threshold for which election candidates can accept anonymous gifts.


NOTES ON CLAUSES

Clause 1. Short title

When passed, the bill will be known as the Electoral Amendment (No. 2) Act 2007

Clause 2. Act amended

The Act to be amended is the Electoral Act.

Clause 3. Amendment of section 41 (Determination of order of candidates names)

Section 41 requires the NT Electoral Commission to determine the order of candidates' names on ballot papers. Section 41(2) states this determination must be made by lot draw in view of the public at the Commission's office.

The amendment changes 41(2) by stating the draw will be at a place determined by the Commission. This will allow the Commission to hold a draw in a place other than the Commission's office, such as a city or town within the electorate which is the subject of the election (in the case of by-elections).

The amendment further states the place of the draw must be notified in the Gazette.

Clause 4. Amendment of section 191 (Disclosure of gifts - reporting agent of candidate)

Section 191 requires candidates' reporting agents to provide the Electoral Commission with details of gifts given to the candidate in an election. This information must state the total amount of all gifts, how many people provided those gifts, the date and amount of each gift, and the name and address of the donors providing each gift.

However, section 191(3) states the date, amount, and donor's name is not required if the total amount of their gift/s is less than $200.

The amendment changes this amount to $1,000.

Clause 5. Amendment of section 193 (Donations to candidates)

Section 193 concerns a person (other than a candidate, registered party, or associated entity) who makes a gift to a candidate in an election. If the total amount of their gift/s is $200 or more the person must inform the Electoral Commission of their name, address, amount of the gift, and date it was gifted.

The amendment increases the amount of $200 to $1,000.

Clause 6. Amendment of section 197 (Anonymous gifts)

Section 197 concerns registered parties or candidates receiving anonymous gifts.

For registered parties, they must not accept a gift to the value of $1,000 or more unless the receiver knows the name and address of the donor.

For candidates not with registered parties, the same rule applies, except the prescribed amount is $200.

The amendment increases the amount of $200 to $1,000.
