AMENDMENT BILL 2007
EXPLANATORY STATEMENT
GENERAL OUTLINE
The purpose of this Bill is to amend the Darwin Waterfront Corporation Act (the “DWC Act”) to clarify that:
· the maintenance of water quality within certain areas of the Darwin Waterfront Precinct is a municipal function of the Darwin Waterfront Corporation;
· the Corporation has the ability to enter into arrangements with the Darwin City Council or other bodies under which the Council or other body can perform functions of the Corporation; and
· lessees of land owned by the Corporation are liable to pay rates to the Corporation.
NOTES ON CLAUSES
Clause 1 Short Title
This is a formal clause which provides for the citation of the Bill. The Bill when passed may be cited as the Darwin Waterfront Corporation Amendment Act 2007.
Clause 2 Act Amended
The Bill, when passed, will amend the DWC Act.
Clause 3 Amendment of Section 12 (Functions of Corporation)
This clause:
(a) deletes section 12(3) of the DWC Act, which provides for the maintenance of water quality in enclosed areas of water within the Precinct as a function of the Corporation, so that this function can clearly stated as a municipal function of the Corporation under section 13 (see explanation of clause 4 for further detail);
(b) inserts a new section 12(3) into the Act that allows the Corporation to enter into arrangements with the Darwin City Council or other persons or bodies whereby the Darwin City Council, persons or bodies can perform specified functions of the Corporation; and
(c) inserts a new section 12(4) into the DWC Act to clarify that arrangements made between the Corporation and the Darwin City Council or other body or person may provide for the Council or other person or body to exercise powers of the Corporation.
Clause 4 Amendment of section 13 (Municipal Services)
This clause takes the wording deleted from section 12(3) of the Act and inserts that wording into a new section 13(1)(ea) in order to clarify that the maintenance of water quality in certain areas of the Darwin Waterfront Precinct is a municipal function of the Corporation.
Clause 5 Amendment of section 18 (Corporation exempt from certain taxes and charges)
This clause inserts a new section 18(3) which clarifies that, subject to laws of the Territory which provide otherwise, lessees of land owned by the Corporation are liable to pay rates to the Corporation.
