The Legislative Assembly of the Northern Territory enacts
as follows:
Short title
This Act may be cited as the Sentencing Amendment
(Cultural Practice and Customary Law) Act 2006.

This Act amends the Sentencing
Act.
Amendment of section 5 (Sentencing
guidelines)
(1) Section 5(2)

a court shall have regard to
–
substitute
a court must, subject to subsection (5), have regard
to:

(5) A court must not have regard to any of the following
matters in sentencing an offender:
(a) a cultural practice of a community of which the offender
is a member;
(b) a customary law to which the offender may be subject as
a member of a community.
