to amend the Residential Tenancies Act

The Legislative Assembly of the Northern Territory enacts as follows:


1. Short title
This Act may be cited as the Residential Tenancies Amendment Act 2005.

2. Commencement
This Act comes into operation on the date fixed by the Administrator by notice in the Gazette.

3. Principal Act amended
This Act amends the Residential Tenancies Act.

4. New section 100A
After section 100 in Part 11, Division 4 –

insert

100A. Evidence of unacceptable behaviour

(1) In support of an application under section 100, a landlord may present to the court an affidavit or statutory declaration to which is annexed copies of 4 written complaints that have been received by the landlord and relate to the ground for termination alleged in the application.

(2) The affidavit or statutory declaration is evidence of –

(3) This section does not prevent the landlord from presenting other evidence to the court in support of the application.
