AN ACT

to amend the Northern Territory Tourist Commission Act

E it enacted by the Legislative Assembly of the Northern Territory of Australia, with the assent as provided by the Northern Territory

(Self-Government) Act 1978 of the Commonwealth, as follows:

1. SHORT TITLE
This Act may be cited as the Northern Territory Tourist Commission Amendment Act 1998.

2. COMMENCEMENT
This Act comes into operation on the date fixed by the Administrator by notice in the Gazette.

3. PRINCIPAL ACT
The Northern Territory Tourist Commission Act is in this Act referred to as the Principal Act.

4. INTERPRETATION
Section 4 of the Principal Act is amended —

(a) by omitting "section 6(1)(a), (d), (e), (f), (g), (h) or (j)" from the definition of "appointed member" and substituting "section 6(b)"; and

(b) by omitting the definition of "Chairman" and substituting the following:

"'Chairperson' means the Chairperson of the Commission and includes an acting Chairperson;".

5. repeal and substitution
Section 6 of the Principal Act is repealed and the following substituted:

"6. COMPOSITION OF COMMISSION

"(1) The Commission consists of —

(a) the chief executive officer; and

(b) 5 persons appointed by the Minister.

"(2) The Minister must appoint an appointed member to be the Chairperson of the Commission.

"(3) The exercise of a power or the performance of a function by the Commission is not affected by reason only of the office of a member being vacant.".

6. dismissal
Section 12 of the Principal Act is amended —

(a) by omitting from subsection (1) all words after "mental incapacity"; and

(b) by omitting from subsection (2) "his" (wherever occurring) and substituting "his or her".

7. meetings of commission
Section 15 of the Principal Act is amended —

(a) by omitting from subsection (1) "6 meetings" and substituting "4 meetings";

(b) by omitting from subsections (1) and (2) "Chairman" and substituting "Chairperson";

(d) by omitting from subsection (2)(a) "6 members" and substituting "4 members".

8. delegation
Section 20 of the Principal Act is amended by adding at the end of subsection (1) "or a person employed by the Commission".

9. staff
Section 21 of the Principal Act is amended —

(a) by omitting from subsection (1) "the Commission may" and substituting "the chief executive officer, on behalf of the Commission, may"; and

(a) by omitting from subsection (5) ", subject to the control of the Commission,".

10. Consultants
Section 22 of the Principal Act is amended —

(a) by omitting "The Commission may" and substituting "The chief executive officer, on behalf of the Commission, may"; and

(b) by inserting "for it" after "arrangements".

11. formal amendments
The Principal Act is amended as set out in the Schedule.

12. Termination of appointments of members of commission
(1) A person who is a member of the Commission appointed under the Principal Act, as in force before the commencement of this Act, ceases to be a member on that commencement.

(2) A person referred to in subsection (1) may be re-appointed a member in accordance with the Principal Act as amended by this Act.

NOTE

On the day on which the Northern Territory Tourist Commission Act is amended by this Act the heading to section 8 of the Northern Territory Tourist Commission Act is altered by omitting "CHAIRMAN" and substituting "CHAIRPERSON".
