The Legislative Assembly of the Northern Territory enacts as follows:
This Act may be cited as the Electoral Amendment Act 2005.
This Act amends the Electoral Act.
After section 295 –
insert
Subdivision 7 – Other offences
295A. Damaging etc. electoral material
(1) A person must not without lawful authority –
(a) destroy or damage any electoral material; or
(b) for electoral material that is lawfully fixed to a place or object or lawfully left at a place – remove or move the material from the place or object.
Penalty: 50 penalty units or imprisonment for 3 months.
Examples for subsection (1) –
1. Defacing an election poster.
2. Moving an election poster from the place to which it is fixed.
3. Removing an election pamphlet from a letterbox.
(2) In this section –
"damage", for electoral material, includes deface, vandalise, tamper with and otherwise interfere with the material;
"electoral material" means an electoral advertisement, notice, handbill or pamphlet.
