The Legislative Assembly of the Northern Territory enacts as follows:

Short title

This Act may be cited as the Criminal Code Amendment (Child Sexual Offence) Act 2009.

Commencement

This Act commences on the date fixed by the Administrator by Gazette notice.

Act amended

This Act amends the Criminal Code.

Amendment of section 127 (Sexual intercourse or gross indecency involving child under 16 years)

After section 127(4)

insert

(4A) It is also a defence to a charge of a crime defined by this section to prove:

(a) the child was of or above the age of 14 years; and

(b) the age difference between the accused person and the child is no more than 2 years; and

(c) there was no coercion of the child, by the accused person or another person, to engage in the sexual intercourse or act of gross indecency.

(4B) Subsection (4A) applies even if the crime defined by this section is alleged to have been committed before the commencement of that subsection.
