His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Environmental Trust Act 1998.
Minister for the Environment

Explanatory note

The Environmental Trust Act 1998 repealed the Environmental Restoration and Rehabilitation Trust Act 1990, the Environmental Research Trust Act 1990 and the Environmental Education Trust Act 1990, replacing the 3 separate Trusts established under those Acts with a single Environmental Trust to provide funding for environmental purposes.
Under the repealed Acts, grants were made subject to a condition that they be expended within 2 years after they were made. The object of this Regulation is to extend, from 2 years to 3 years, the time within which grants made under the repealed Acts must be expended. The 3 year period corresponds with the time within which grants made under the Environmental Trust Act 1998 must be expended.
This Regulation is made under the Environmental Trust Act 1998, including section 25 (the general regulation-making power) and clause 1 of Schedule 3.
This Regulation comprises or relates to matters set out in Schedule 3 to the Subordinate Legislation Act 1989, namely matters of a savings or transitional nature.
