New South Wales Repealed RegulationsThis legislation has been repealed.
(1) A subpoena shall not require the person named to attend or to produce any document or thing on any day unless an amount sufficient to meet the reasonable expenses of the person named of complying with the subpoena in relation to that day is paid or tendered to him at the time of service of the subpoena or not later than a reasonable time before that day.
(2) An amount is not sufficient for the purpose of subrule (1) if it is less than the amount which would be payable in respect of the person named if the party issuing the subpoena were entitled to claim witness’ expenses in respect of that person as costs in the proceedings, including for travelling and other expenses:(a) for the distance necessary to be travelled by the person named in attending the Court:(i) if not exceeding 80 kilometres-80 cents per kilometre one way after the first kilometre, or(ii) if exceeding 80 kilometres-the reasonable cost of travel, and(b) for sustenance and accommodation, where necessarily incurred, such amount as having regard to all the circumstances is reasonable.
