Absence of privilege

18.5 Absence of privilege

(1) Except with the leave of the Court, a party to any proceedings may not claim to be excused from production of any document on the ground that it relates solely to and does not tend to impeach his own case and does not relate to or tend to support the case of any opposing party.
(2) Leave under subrule (1) shall not be granted except for special cause.
(3) Any application to the Court for leave under subrule (1) may be made without serving notice of the motion.
