Persons from whom licensees may obtain fee, charge or other remuneration

19 Persons from whom licensees may obtain fee, charge or other remuneration

(1) A licensee must not, in connection with the business of a private employment agent, demand or receive any fee, charge or other remuneration except from a person for whom the licensee finds or assists in finding a person to undertake employment or otherwise to carry out work.
Maximum penalty: 50 penalty units.
(2) It is immaterial whether the work or employment is to be carried out or undertaken pursuant to a contract of employment or otherwise.
(3) If any fee, charge or remuneration is received in contravention of this section, the amount concerned may be recovered from the licensee in a court of competent jurisdiction as a debt due to the person who paid that amount.
