MAITLAND TO MORPETH RAILWAY (CESSATION OF OPERATION) ACT. Act No. 38, 1953.

An Act to discontinue the operation of the railway between Maitland and Morpeth; to make certain provisions consequential upon such discontinuance; to amend the Govern ment Railways Act, 1912-1952; to validate certain matters; and for purposes connected therewith. [Assented to, 16th December, 1953.]

E it enacted by the Queen's Most Excellent Majesty, by and with the advice a n d consent of the Legis lative Council a n d Legislative Assembly of New South W a l e s in P a r l i a m e n t assembled, a n d by the a u t h o r i t y of t h e same, as follows:--

1 . (1) T h i s Act m a y be cited as the " M a i t l a n d to M o r p e t h R a i l w a y (Cessation of O p e r a t i o n ) Act, 1 9 5 3 . " (2) This Act shall be deemed to have commenced on the thirty-first d a y of A u g u s t , one t h o u s a n d nine hundred and fifty-three. 2 . T h e Commissioner for R a i l w a y s shall cease to o p e r a t e the r a i l w a y between M a i t l a n d a n d M o r p e t h , a n d a n y duties or obligations imposed u p o n The Commis sioner for R a i l w a y s by the G o v e r n m e n t R a i l w a y s Act, 1912, as a m e n d e d by subsequent Acts, t h e P u b l i c W o r k s Act, 1912, as a m e n d e d by subsequent A c t s , or a n y o t h e r A c t of P a r l i a m e n t , or b y a g r e e m e n t , contract, deed, or by o p e r a t i o n of law in r e l a t i o n to the said r a i l w a y or a n y of the l a n d s or works connected t h e r e w i t h or adjoining t h e r e t o , or the c a r r i a g e of p e r s o n s , a n i m a l s a n d goods upon the said railway, a r e h e r e b y extinguished. 3 . A n y l a n d r e s u m e d or t a k e n for the p u r p o s e s of the said r a i l w a y m a y be dealt with as superfluous l a n d s u n d e r the Public W o r k s Act, 1912, as amended by subsequent Acts.
