New South Wales Consolidated Regulations New South Wales Consolidated RegulationsNotwithstanding any other provisions of this plan, the council shall not consent to the erection of any building or the carrying out of any work on land subject to flooding to which Wagga Wagga Local Environmental Plan 1985 (Amendment No 4) applies, if, in the opinion of the council:
(a) the carrying out of the development is likely to impede the flow of flood waters on the land or on land in its immediate vicinity, or
(b) the safety of the building or work would be adversely affected in time of flood.
