New South Wales Consolidated Regulations New South Wales Consolidated RegulationsWhere the council owns land which is within the Open Space Zone, the council shall not consent to an application to carry out development on that land unless it has made an assessment of:
(a) the need for the proposed development on that land,
(b) the impact of the proposed development on the existing or likely future use of the land, and
(c) the need to retain the land for its existing or likely future use.
