WATER SHARING PLAN FOR THE NEW SOUTH WALES MURRAY AND LOWER DARLING REGULATED RIVERS WATER SOURCES 2003 - REG 16
Adaptive environmental water
16 Adaptive environmental water
(1) At any time an access licence holder
may, by a process determined by the Minister, commit all or part of their
licence as adaptive environmental water.
(2) The Minister may grant an access
licence in a water source to which this Plan applies if the licence is subject
to an adaptive environmental water condition and arises through water savings
in the system made in that water source as referred to in section 8C (1) of
the Act.
(2A) The Minister may change the category or subcategory of an
access licence in a water source to which this Plan applies if the licence is
subject to an adaptive environmental water condition that arises through water
savings as referred to in section 8D of the Act.
(3) The following licences
shall be granted to and held by the Ministerial Corporation, committed as
adaptive environmental water and made subject to the relevant mandatory
condition set out in Part 11 of this Plan: (a) a regulated river (conveyance)
access licence with a share component of 30,000 unit shares, and
(b) a
regulated river (high security) access licence with a share component of 2,027
unit shares.
Note: The licence referred to in subclause (3) (a) is a
consequence of the Murray Irrigation Limited privatisation arrangements and
the licence in (3) (b) is the result of water savings resulting from works
installed to regulate inflows to Moira Lake.
(4) The management of water
allocations accruing to the access licences in subclause (3) should be in
accordance with a protocol established by the Minister in consultation with
the Minister for the Environment.
