WATER SHARING PLAN FOR THE BELLINGER RIVER AREA UNREGULATED AND ALLUVIAL WATER SOURCES 2008 - REG 27
Bulk access regime
27 Bulk access regime
(1) This Part is made in accordance with section 20 (1) (e) of the Act.
(2)
This Plan establishes a bulk access regime for the extraction of water under
access licences in these water sources having regard to: (a) the environmental
water provisions established under Part 4 of this Plan,
(b) the requirements
for basic landholder rights identified under Part 5 of this Plan, and
(c) the
requirements for water for extraction under access licences identified under
Part 7 of this Plan.
(3) The bulk access regime established in subclause (2):
(a) recognises the effect of climate variability on the availability of water
as provided for under Part 3 of this Plan,
(b) establishes rules according to
which access licences are granted as provided for in Part 8 of this Plan,
(c)
recognises and is consistent with limits to the availability of water as
provided for in Part 10, Division 1 of this Plan,
(d) establishes rules
according to which available water determinations are to be made as provided
for in Part 10, Division 1 of this Plan,
(e) establishes rules according to
which access licences are managed as provided for in Parts 10 and 11 of this
Plan, and
(f) establishes rules with respect to the priorities according to
which access licences are to be adjusted as a consequence of any reduction in
the availability of water as provided for in Part 10 of this Plan.
