WOLLONGONG LOCAL ENVIRONMENTAL PLAN NO 38 - REG 17
Dwellings in Zone No 2 (a), 2 (b), 2 (e), 2 (f), 3 (a), 3 (b), 3 (c), 3 (d) or 6 (c)
17 Dwellings in Zone No 2 (a), 2 (b), 2 (e), 2 (f), 3 (a), 3 (b), 3 (c), 3 (d)
or 6 (c)
(1) A person shall not erect a second or subsequent dwelling-house on an
allotment of land within Zone No 2 (a), 2 (b), 2 (e) or 2 (f) on which 1 or
more dwelling-houses are situated except with development consent.
(2) The
council shall not consent to the carrying out of development for the purposes
of a dwelling in Zone No 3 (a), 3 (b), 3 (c), 3 (d) or 6 (c) unless: (a) where
there is, or is to be, only 1 dwelling contained in the building
concerned-that dwelling is situated behind or above commercial premises or a
shop, or
(b) where there is, or is to be, more than 1 dwelling contained in
the building concerned-those dwellings are situated above commercial premises
or a shop.
