New South Wales Consolidated RegulationsBefore granting consent for development, the Council must consider whether the proposed development is likely to have an adverse impact on an adjoining or nearby property by causing loss of views, loss of privacy or a reduction of sunlight to the living areas or principal open space recreation areas, and whether:
(a) there are no other design alternatives that would mitigate the impacts, or
(b) there are special circumstances applying to the site or its context.
