Subdivision of land within Zone No 1 (a1)
14 Subdivision of land within Zone No 1 (a1)
(1) The Council shall not consent to the subdivision of land within Zone
Number 1 (a1), unless it is satisfied that: (a) the allotment to be created is
intended to be used for the purpose of intensive agriculture and is capable of
being used for a range of intensive agricultural uses,
(b) an irrigation
licence is available to service the intensive agricultural use of the land,
and
(c) the soil, topography, drainage, and other physical characteristics of
the land are suitable for the proposed intensive agricultural use.
(3) The
Council may refer an application to subdivide land within Zone Number 1 (a1)
to an expert body with a request for comment and, in determining that
application, shall take into account any comments received by the Council
within 21 days of the Council’s request for comments, or such longer period
as the Council allows.
