New South Wales Consolidated RegulationsWhere the consent authority receives an application to carry out development on land which comprises a potential historical archaeological site, the consent authority must not grant consent to the application unless:
(a) it has received from the applicant and considered a conservation plan which includes an assessment of how the proposed development would affect the conservation of the site, and
(b) in the case of development involving the disturbance or excavation of the land, any excavation permit required under the Heritage Act 1977 has been obtained.
