41 Development of certain land, Remembrance Driveway, Camden Park

(1) This clause applies to “Camden Park Urban Release Area”, meaning the land consisting of Lots 1 and 2, DP 551376 and Lots 2, 3, 4 and 5, DP 233005.
(2) The council shall not consent to any development until it has approved a development control plan that contains comprehensive provisions relating to the subdivision of, building on and the landscaping of, the land to which this clause applies and includes details about colours of, and materials to be used in the exteriors of buildings, trees to be retained plantings to be made, fencing and the position of building envelopes and access roads.
(3) The council shall not consent to the subdivision of so much of the land to which this clause applies within Zone No 1 (c1) (iii) or 2 (a), as is shown edged heavy black on the map marked “ Wollondilly Local Environmental Plan 1991 (Amendment No 37) ” unless the site is capable of being serviced by a reticulated sewerage system.
(4) The council shall not consent to residential development on land the surface of which is or, after any proposed filling has been carried out, will be below the 1 percent annual event probability post-mining flood level (which is taken to be 72.6 metres AHD), unless the council is satisfied that a different flood level should apply.
(5) The council shall not consent to residential development if the floor level of any habitable part of a residential building resulting from the carrying out of the development will be less than the height above that flood level that is considered by the council as adequate to avoid any adverse effect from flooding.
(6) No residential development shall occur within 150 metres of the existing silage pits within the Elizabeth Macarthur Agricultural Institute, or such lesser distance from them as is identified as being potentially affected by offensive odour in an odour impact study prepared in accordance with the council’s requirements and adopted by the council.
(7) Development for the purpose of exhibition homes or exhibition villages may be carried out with development consent on land to which this clause applies.
(8) In this clause:
"exhibition home" means a dwelling built for the purposes of public exhibition and marketing which is intended to be used as a private dwelling after it has been used for those purposes and may include a sales office, and a place used for providing home financing, a materials display and the sale of take-away food, and the like.
"exhibition village" means a contiguous group of exhibition homes and other buildings or works used for the purpose of promoting house sales including sales offices, and places used for providing home financing, a materials display and the sale of take-away food, and the like.
