WOLLONDILLY LOCAL ENVIRONMENTAL PLAN 1991 - REG 13E

Development of certain land within Zone No 7 (e) at Buxton

13E Development of certain land within Zone No 7 (e) at Buxton

(1) This clause applies to land within Zone No 7 (e) at Buxton, as shown edged heavy black and lettered “7 (e)” on the map marked “ Wollondilly Local Environmental Plan 1991 (Amendment No 19) ”.
(2) In this clause, "building precinct" means land shown edged heavy black and horizontally hatched on that map, and includes any area of land to which this clause applies which extends 5 metres from the edge of any land shown horizontally hatched on the map.
(3) The council may consent to the erection of a dwelling-house, outbuilding, fencing or other structure only if it is situated within the building precinct.
(4) In determining an application for consent for any such dwelling-house, outbuilding, fencing or other structure, the council must take into account the following considerations:
(a) the potential impact of the proposed development on the ecological significance of the site,
(b) the land capability of the site,
(c) the ability of the site to support an effluent disposal area,
(d) the potential impact of the proposed development on the water quality of receiving streams.
(5) The council may grant consent to only one dwelling-house on land within the building precinct.
