69 Preliminary matters to be dealt with by Vice-Chancellor or Student
Proctorial Board
(1) In the hearing of an allegation of misconduct against a student, the
Vice-Chancellor or a Board has power: (a) to summon any member of the
University staff or any student to appear to give evidence in relation to the
allegation, and
(b) to obtain information as to the facts concerning the
allegation in any way the Vice-Chancellor or the Board sees fit and may at any
stage seek further information in any manner reasonably possible, and
(c) to
determine the procedure of the hearing.
(2) The Vice-Chancellor or Board
must: (a) ensure that the student and any witnesses have been correctly
identified and that the allegations of misconduct against the student have
been made known to the student, and
(b) if satisfied that there is
insufficient evidence to establish the allegation of misconduct, dismiss the
allegation without calling on the student to answer it, and
(c) if satisfied
that there is a case to answer with respect to the allegation, give the
student an opportunity to answer the allegation.
