(b) development consent under Part 4 of the Act,in relation to oyster aquaculture development, being an application that was made but not finally determined before the commencement of State Environmental Planning Policy No 62-Sustainable Aquaculture (Amendment No 3) , is to be determined as if that Policy had not commenced.
