SUPREME COURT RULES 1970 - SECT 71A.3
Title and parties
71A.3 Title and parties
(1) A document in any proceedings in the Court under
Part 6 of the Service and Execution of Process Act shall be entitled between:
(a) as plaintiff, the person in whose favour judgment was given or order made,
and
(b) as defendant: (i) the person against whom execution is issued or
other proceedings taken upon the judgment registered under that Act, or
(ii)
the applicant for a stay under section 106 of that Act.
(2) In proceedings
under section 57 (1), section 67 (1), section 76 (1), section 79 (1) or
section 93 (1) of the Service and Execution of Process Act, no person shall be
joined as a defendant.
