Ensuring identification by eligible witnesses
16A Ensuring identification by eligible witnesses
(1) For the purposes of section 117 (5) of the Act, a witness is to be
considered as having taken reasonable steps to ensure the identity of a person
executing an application, dealing or caveat if the witness has taken the steps
set out in this clause.
(2) The witness must sight: (a) an original of a
primary photographic identification document in respect of the other person,
or
(b) an original of a primary non-photographic identification document in
respect of the other person and an original of a secondary identification
document in respect of the other person.
(3) A document referred to in this
clause does not include a document that has expired (other than in the case of
an Australian passport that has been expired for less than 2 years).
