Destruction or disposal of records
31 Destruction or disposal of records
(1) An employer must not destroy or otherwise dispose of any records required
to be kept under this Regulation otherwise than in accordance with this
clause. Maximum penalty: 25 penalty units.
(2) An employer may, with the
consent of the Director-General, destroy or otherwise dispose of any records
that the employer is required by this Regulation to keep.
(3) The
Director-General is not to give consent to the destruction of any records kept
under clause 18 by an employer until at least 5 years after the cessation of
employment with the employer of the employee concerned.
(4) An employer may
forward to the Director-General the records kept under this Regulation by the
employer if the employer ceases to carry on business in New South Wales.
(5)
The Director-General may dispose of any records forwarded to or kept by the
Director-General in accordance with this Regulation.
