41 Complaints and discipline
(1) The following provisions of the Act are prescribed as provisions that
remain applicable to a suspended licence or certificate of registration for
the purposes of section 192 of the Act: (a) section 74 (Requirement to
substantiate selling price estimates-residential property),
(b) section 100
(Director-General may require information),
(c) section 107 (Power to require
production of licensee’s records),
(d) sections 111 (Requirement for audit)
and 113 (Statutory declaration required when no trust money held or received),
except when a receiver or manager has been appointed,
(e) section 179
(Production of documents),
(f) section 184 (Powers of accounts examiner),
(g) section 211 (Fraudulent conversion and false accounts of money received by
licensee or registered person),
(h) section 212 (Fraudulent accounts for
expenses, commission and other charges).
(2) The following provisions of this
Regulation are prescribed as provisions that remain applicable to a suspended
licence or certificate of registration for the purposes of section 192 of
the Act: (a) clause 9 (Itemised account),
(b) clause 32 (Furnishing of
particulars of trust account or transactions),
(c) clause 40 (Managing agent
to permit executive committee to inspect records).
