Records of livestock sales to be kept by stock and station agents
37 Records of livestock sales to be kept by stock and station agents
(1) A stock and station agent who sells livestock as an agent (whether or not
by auction) or who offers livestock for sale by auction as an agent must keep
a written record of the sales at the agent’s registered office.
(2)
Immediately after being engaged to sell livestock by auction as an agent, a
stock and station agent must record the following particulars: (a) the name of
the owner of the livestock,
(b) the number of livestock to be sold,
(c) a
description of the livestock that is sufficient to identify the livestock.
In
the case of a sale by auction, the record must be made for each lot of the
livestock and each lot number must be recorded.
(3) Immediately after selling
livestock as an agent, a stock and station agent must record the following
particulars for each lot of livestock sold: (a) the date and place of the
sale,
(b) the name of the purchaser or, if the stock was sold by auction, the
name supplied under section 83 of the Act by the successful bidder as the name
of the purchaser and the lot number,
(c) the price for which the livestock
was sold per kilogram of live weight or per head,
(d) the details of the live
weight weighing, if the livestock was sold on a live weight basis,
(e) the
total price for which the livestock was sold.
Maximum penalty: 40 penalty
units in the case of a corporation or 20 penalty units in any other case.
