Exemption from section 8 (1) in respect of providing animals with drink during transport
37A Exemption from section 8 (1) in respect of providing animals with drink
during transport
(1) A person who is subject to, and complies with, the requirements of
the relevant Standards in respect of providing an animal with access to water
during the transport process (within the meaning of the Standards) is exempt
from the operation of section 8 (1) of the Act in respect of providing the
animal with drink during that transport process.
(2) A person does not lose
the benefit of the exemption under this clause because of a failure to comply
with the relevant Standards if the failure occurs despite the person having
done all that the person could reasonably be expected to have done to comply
with those Standards.
"relevant Standards" means the Prevention of Cruelty to Animals (Land
Transport of Livestock) Standards 2013 No 2 approved by the Minister and
published on the NSW legislation website.
