PARRAMATTA LOCAL ENVIRONMENTAL PLAN 1996 (HERITAGE AND CONSERVATION) - REG 2 Objectives 2 Objectives The objectives of this plan in relation to heritage are: (a) to conserve the environmental heritage of the City of Parramatta, and (b) to retain the cultural significance of the City of Parramatta, and (c) to conserve existing significant fabric, settings, relics and views associated with the heritage significance of heritage items and heritage conservation areas, and (d) to ensure that any development does not adversely affect the heritage significance of heritage items and heritage conservation areas and their settings, and (e) to ensure that known or potential archaeological sites and places of Aboriginal significance are conserved, and (f) to ensure that the heritage conservation areas throughout the City of Parramatta retain their heritage significance. PARRAMATTA LOCAL ENVIRONMENTAL PLAN 1996 (HERITAGE AND CONSERVATION) - REG 3 Land to which plan applies 3 Land to which plan applies (1) This plan applies to all land situated within the local government area of the City of Parramatta. (2) However, this plan does not apply to land within the City Centre, Harris Park, Government, Camellia or Rydalmere Precincts within the meaning of Sydney Regional Environmental Plan No 28—Parramatta. PARRAMATTA LOCAL ENVIRONMENTAL PLAN 1996 (HERITAGE AND CONSERVATION) - REG 4 Relationship to other environmental planning instruments 4 Relationship to other environmental planning instruments (1) This plan amends: (a) Parramatta Local Environmental Plan 1993 (Dundas Ward) in the manner set out in clause 5, and (b) Parramatta Local Environmental Plan 1990 (Toongabbie Ward) in the manner set out in clause 6, and (c) Parramatta Local Environmental Plan 1989 (City Centre) in the manner set out in clause 7, and (d) the Parramatta Planning Scheme Ordinance in the manner set out in clause 8. (2) Parts 1 (Preliminary) and 2 (Primary Centre controls) of Sydney Regional Environmental Plan No 28—Parramatta apply to land to which this plan applies if it is within the Parramatta Primary Centre, within the meaning of that plan. PARRAMATTA LOCAL ENVIRONMENTAL PLAN 1996 (HERITAGE AND CONSERVATION) - REG 7 Amendment of Parramatta Local Environmental Plan 1989 (City Centre) 7 Amendment of Parramatta Local Environmental Plan 1989 (City Centre) Parramatta Local Environmental Plan 1989 (City Centre) is amended: (a) by omitting clauses 2 (1) (d) (iii), 11 (1) (c), (2) and (3), 13, 15 (3), 16 (5) (d), 18 (3) (b) and 21–27, (b) by omitting from clause 5 (1) the definitions of "conservation area", "demolition", "heritage and conservation map", "item of the environmental heritage", "relic" and "renovation", (c) by inserting in clause 5 (1) in alphabetical order the following definition: "heritage item" has the same meaning as in Parramatta Local Environmental Plan 1996 (Heritage and Conservation). (d) by omitting from the Table to clause 9 Item 1 (b) of the matter relating to Zone No 2 (b2) and by inserting instead the following paragraph: (b) to provide opportunities for small scale business and skilled trades as an adjunct to the Centre and as a means of retaining heritage items. (e) by omitting from the Table to clause 9 Item 1 (c) of the matter relating to Zone No 3 (f) and by inserting instead the following paragraph: (c) to ensure that development is arranged and carried out in a way that preserves views to and from the Centre, and appropriately relates to heritage items within the Centre, (f) by omitting clause 14 (1) (d) and by inserting instead the following paragraph: (d) the development does not significantly detract from a heritage item, the setting of a heritage item or views to a heritage item from a public place, (g) by omitting clause 15 (6) and by inserting instead the following subclause: (6) Not more than 30 per cent of the total floor space of a building in Zone No 3 (f) or 3 (f–r), other than a heritage item, shall be erected or used for residential purposes. (h) by omitting Schedule 2. PARRAMATTA LOCAL ENVIRONMENTAL PLAN 1996 (HERITAGE AND CONSERVATION) - REG 8 Amendment of Parramatta Planning Scheme Ordinance 8 Amendment of Parramatta Planning Scheme Ordinance The Parramatta Planning Scheme Ordinance is amended: (a) by omitting clauses 77, 77G, 77HA and 77I (as inserted by Parramatta Local Environmental Plan No 198 published in Gazette No 34 of 24 March 1995 at pages 1693–4), (b) by omitting Schedules 8, 9 and 12. PARRAMATTA LOCAL ENVIRONMENTAL PLAN 1996 (HERITAGE AND CONSERVATION) - REG 9 What definitions apply? 9 What definitions apply? (1) A term defined in the Dictionary has the same meaning when used in this plan. (2) In this plan: (a) a reference to a use of land includes a reference to a use of land of the same kind that is proposed, and (b) a reference to a map is a reference to a map kept in the office of the Council. PARRAMATTA LOCAL ENVIRONMENTAL PLAN 1996 (HERITAGE AND CONSERVATION) - REG 10 Consent authority 10 Consent authority The Council is the consent authority for the purposes of this plan. PARRAMATTA LOCAL ENVIRONMENTAL PLAN 1996 (HERITAGE AND CONSERVATION) - REG 11 Protection of heritage items, heritage conservation areas and relics 11 Protection of heritage items, heritage conservation areas and relics When is consent required? (1) The following development may be carried out only with development consent: (a) demolishing or moving a heritage item or a building, work, relic, tree or place within a heritage conservation area, (b) altering a heritage item or a building, work, relic or place within a heritage conservation area by making structural or non-structural changes to its exterior, including changes to its external detail, fabric, finish or appearance, (c) altering a heritage item by making structural changes to its interior, (d) moving a relic, or excavating land and discovering, exposing or moving a relic, (e) demolishing, dismantling, moving or altering a heritage item, (f) erecting a building on, or subdividing, land on which a heritage item is located or which is within a heritage conservation area. What exceptions are there? (2) Development consent is not required if: (a) the consent authority is of the opinion that the proposed development is of a minor nature or consists of maintenance of a heritage item or a building, work, relic, tree or place within a heritage conservation area, and (b) the consent authority is of the opinion that the proposed development would not adversely affect the heritage significance of the heritage item or heritage conservation area concerned, and (c) the proponent has notified the consent authority in writing of the proposed development and the consent authority has advised the proponent in writing before the development is carried out that it is satisfied that development consent is not required because of the exception allowed by this provision. (3) Development consent is not required by this clause for the creation of a new grave or monument in a graveyard that is a heritage item if the development does not involve demolishing, excavating, defacing or damaging an existing grave, monument or Aboriginal place. What must be included in assessing a development application? (4) When determining a development application required by this clause, the consent authority must assess the extent to which the carrying out of the proposed development would affect the heritage significance of the heritage item or heritage conservation area concerned. (5) The assessment is to include (but is not limited to) consideration of: (a) for development that would affect a heritage item: (i) the heritage significance of the item as part of the environmental heritage of the City of Parramatta, and (ii) the impact that the proposed development will have on the heritage significance of the item and its setting, including any landscape or horticultural features, and (iii) the measures proposed to conserve the heritage significance of the item and its setting, and (iv) whether any archaeological site or potential archaeological site would be adversely affected, and (v) the extent, if any, to which the carrying out of the proposed development would affect the form of an historic subdivision, and (vi) any submission received in relation to the proposed development in response to the notification or advertising of the application, and (b) for development that would be carried out in a heritage conservation area: (i) the heritage significance of the heritage conservation area and the contribution which any building, work, relic, tree or place affected by the proposed development makes to this heritage significance, and (ii) the impact that the proposed development would have on the heritage significance of the heritage conservation area, and (iii) the compatibility of any proposed building or work with nearby original buildings and the character of the heritage conservation area, including compatibility with the existing size, form, scale, orientation, setbacks, materials and detailing, and (iv) the measures proposed to conserve the significance of the heritage conservation area and its setting, and (v) whether any landscape or horticultural features of heritage significance would be affected, and (vi) whether any archaeological site or potential archaeological site would be affected, and (vii) the extent, if any, to which the carrying out of the proposed development would affect an historic subdivision pattern, and (viii) any submission received in relation to the proposed development in response to the notification or advertising of the application. Note: The website of the Heritage Branch of the Department of Planning has publications that provide guidance on assessing the impact of proposed development on the heritage significance of items (for example, Statements of Heritage Impact). What extra documentation is needed? (6) When determining whether or not to grant a development consent required by this clause, the consent authority: (a) must not grant such a consent until it has considered a heritage impact statement which includes an assessment of the matters raised in subclause 5 (a) (i)–(v) or 5 (b) (i)–(vii), as the case may require, and (b) where it requires that a conservation management plan should also be considered, may refuse to grant the consent unless a conservation management plan has been considered. PARRAMATTA LOCAL ENVIRONMENTAL PLAN 1996 (HERITAGE AND CONSERVATION) - REG 12 Advertised development 12 Advertised development The following development is identified as advertised development: (a) the demolition of a heritage item or a building, work, relic, tree or place in a heritage conservation area, (b) the carrying out of any development allowed by clause 17. PARRAMATTA LOCAL ENVIRONMENTAL PLAN 1996 (HERITAGE AND CONSERVATION) - REG 14 Development adversely affecting a heritage item or heritage conservation area 14 Development adversely affecting a heritage item or heritage conservation area (1) Before granting consent for development that may undermine or otherwise damage a heritage item or a building, work, relic, tree or place within a heritage conservation area or will obscure, overshadow or otherwise have a substantial adverse effect on a view of a heritage item or of a building, work or tree within a heritage conservation area, or that will otherwise adversely affect the heritage significance of a heritage item or heritage conservation area (or that will have a substantial adverse effect on a view from any such item or from habitable places within any such area), the consent authority must assess the impact of the development: (a) on the heritage significance, curtilage and setting of the heritage item or the heritage significance of the heritage conservation area, and (b) on any significant views to or from the heritage item or the heritage conservation area. (2) The consent authority may refuse to grant any such consent unless it has considered a heritage impact statement that will help it to assess the impact of the proposed development on the heritage significance, visual curtilage and setting of the heritage item or the heritage significance of the heritage conservation area. (3) The heritage impact statement should include details of the size, shape and scale of, setbacks for, and the materials to be used in, any proposed buildings or works and details of any modification that would reduce the impact of the proposed development on the significance of the heritage item or the heritage conservation area. PARRAMATTA LOCAL ENVIRONMENTAL PLAN 1996 (HERITAGE AND CONSERVATION) - REG 15 Development of Aboriginal places or of known or potential archaeological sites of Aboriginal cultural heritage significance 15 Development of Aboriginal places or of known or potential archaeological sites of Aboriginal cultural heritage significance (1) Before granting consent for development that is likely to have an impact on an Aboriginal place, or that will be carried out on an archaeological site that has Aboriginal cultural heritage significance or a potential archaeological site that is reasonably likely to have Aboriginal cultural heritage significance, the consent authority must: (a) consider a heritage impact statement explaining how the proposed development would affect the conservation of the site and any relic known or reasonably likely to be located at the site, and (b) notify the local Aboriginal communities (in such a way as it thinks appropriate) of its intention to do so and take into consideration any comments received in response within 21 days after the relevant notice is sent. PARRAMATTA LOCAL ENVIRONMENTAL PLAN 1996 (HERITAGE AND CONSERVATION) - REG 16 Development of other known or potential archaeological sites 16 Development of other known or potential archaeological sites (1) Before granting consent for development that will be carried out on any other archaeological site or potential archaeological site, the consent authority must: (a) consider a heritage impact statement explaining how the proposed development would affect the conservation of the site and any relic known or reasonably likely to be located at the site, and (b) be satisfied that any necessary excavation permit required by the Heritage Act 1977 has been granted. (2) Subclause (1) does not apply if the proposed development will not involve disturbance of below ground relics and the consent authority is of the opinion that the heritage significance of any above ground relics would not be adversely affected by the proposed development. PARRAMATTA LOCAL ENVIRONMENTAL PLAN 1996 (HERITAGE AND CONSERVATION) - REG 17 Conservation incentives 17 Conservation incentives (1) The consent authority may grant consent to the use for any purpose of a building that is a heritage item, or of the land on which a heritage item is erected, even though the use would otherwise not be allowed by an environmental planning instrument, if: (a) it is satisfied that the retention of the building or item depends on the granting of consent, and (b) the proposed use is in accordance with a conservation management plan which has been approved by the consent authority, and (c) the granting of consent to the proposed use would ensure that all necessary conservation work identified in the conservation management plan is carried out, and (d) the proposed use would not adversely affect the heritage significance of the heritage item or its setting, and (e) the proposed use would not adversely affect the amenity of the surrounding area otherwise than to an insignificant extent. Conservation Area Sorrell Street Conservation Area South Parramatta Conservation Area Wyralla Avenue Conservation Area PARRAMATTA LOCAL ENVIRONMENTAL PLAN 1996 (HERITAGE AND CONSERVATION) - SCHEDULE 99 DICTIONARY "Aboriginal cultural heritage significance" means cultural heritage significance to indigenous inhabitants of New South Wales. "Aboriginal place" means: (a) any site which has the physical remains of pre-European occupation by, or is of contemporary significance to, the Aboriginal people. It can (but need not) include items and remnants of the occupation of the land by Aboriginal people, such as burial places, engraving sites, rock art, midden deposits, scarred and carved trees and sharpening grooves, or (b) a natural Aboriginal sacred site or other sacred feature. It includes natural features such as creeks or mountains of cultural significance, as well as initiation, ceremonial or story places or areas of more contemporary cultural significance, such as Aboriginal missions and post-contact sites. "archaeological site" means a site identified in Schedule 1 or 2 by the words “archaeological site” and shown coloured yellow on the Heritage and Conservation Map. It includes a site known to the consent authority to have archaeological significance even if it is not so identified and shown. "conservation management plan" means a document prepared in accordance with the provisions of the New South Wales Heritage Manual that establishes the heritage significance of an item, place or heritage conservation area and identifies conservation policies and management mechanisms that are appropriate to enable that significance to be retained. "Council" means the Council of the City of Parramatta. "demolish" a heritage item or a building, work, relic, tree or place within a heritage conservation area means wholly or partly destroy or dismantle the heritage item or building, work, relic, tree or place. "Heritage and Conservation Map" means the map marked “ Parramatta Local Environmental Plan 1996 (Heritage and Conservation)—Heritage and Conservation Map ”, as amended by the maps (or specified sheets of maps) marked as follows: Parramatta Local Environmental Plan 1996 (Heritage and Conservation)—Amendment 3 (Sheets 1–3) "heritage conservation area" means land described in Schedule 3 and shown edged heavy red on the Heritage and Conservation Map and includes buildings, works, relics, trees and places situated on or within that land. "heritage impact statement" means a statement demonstrating the significance of a heritage item, a property or a relic, an assessment of the impact that proposed development will have on that significance and the measures that are proposed to minimise that impact. "heritage item" means a building, work, relic, tree or place, or a component of a building, work, relic, tree or place that is described in Schedule 1 or 2 and shown coloured yellow on the Heritage and Conservation Map. "heritage significance" means historic, scientific, aesthetic, social, cultural, archaeological, architectural, natural or aesthetic significance. "maintenance" means ongoing protective care of a heritage item or a building, work, relic, tree or place within a heritage conservation area. It does not include alterations, such as carrying out extensions or additions, or the introduction of new materials or technology, such as the use of injectable damp proof courses. "potential archaeological site" means a site identified in Schedule 1 or 2 by the words “potential archaeological site” and shown coloured yellow on the Heritage and Conservation Map. It includes a site known to the consent authority to have potential archaeological significance even if it is not so identified and shown. "relic" means: (a) any deposit, object or material evidence (which may consist of human remains) that is more than 50 years old relating to the use of settlement of the local government area of the City of Parramatta, not being Aboriginal habitation, or (b) any deposit, object or material evidence (which may consist of human remains) of any age relating to Aboriginal habitation of the local government area of the City of Parramatta, whether before or after its occupation by persons of European extraction.
