Exclusion of matters for consideration
4 Exclusion of matters for consideration
(1) Matters required to be considered under section 79C of the EPA Act are
excluded from the matters required to be considered under Part 4 of that Act
for the purposes of the Minister determining a development application for
consent required by the new Act for clearing native vegetation.
(2) A
development application for development consent required by the new Act for
clearing native vegetation is not required to comply with clause 1 (d), (e),
(f) or (h) or 2 (1) (b), (c) or (f) of Part 1 (Development applications) of
Schedule 1 to the Environmental Planning and Assessment Regulation 2000 .
Note: This clause does not affect the operation of Part 4 of the EPA Act in
respect of the granting of additional development consent by a council or
other consent authority to any such clearing of native vegetation that is
required by an environmental planning instrument made before the granting of
consent for the clearing under the new Act (see section 17 of the new Act).
