Excavation of land
39 Excavation of land
(1) Excavation objectives The specific objectives of the excavation of land
controls are to: (a) retain existing vegetation and allow for new substantial
vegetation and trees, and
(b) minimise the adverse effects of excavation on
the amenity of neighbouring properties, and
(c) minimise excavation and site
disturbance so as to retain natural landforms, natural rock faces, sandstone
retaining walls and the like and to retain natural water runoff patterns and
underground water table and flow patterns, and
(d) ensure the structural
integrity of adjoining properties.
(2) Excavation controls Development that
includes excavation must not be carried out unless: (a) the development is in
accordance with and promotes the objectives in subclause (1), and
(b) land
stability of the site and adjoining land is preserved, and
(c) the natural
drainage patterns of the land and catchment will not be disrupted, and
(d)
adverse effects on other properties are avoided or minimised.
