NORTH SYDNEY LOCAL ENVIRONMENTAL PLAN 1989 - REG 9B
Complying development
9B Complying development
(1) Subject to the provisions of the Act, development is complying development
if it is development which: (a) is permissible, with consent, in the zone in
which it is to be carried out, and
(b) is listed in a development category in
Schedule 6, and
(c) satisfies all of the requirements specified in the
standards for the relevant development category in Schedule 6, and
(d)
complies with all quantitative controls specified in the provisions of this
plan which would apply to the development if it were not complying
development,
(e) is not on land reserved for acquisition by a public
authority as identified in an environmental planning instrument.
(2) A
complying development certificate issued for any such development is to be
subject to the conditions specified in Schedule 7.
(3) In addition, a
complying development certificate that relates to the erection of builders
sheds or portable facilities must: (a) state that the sheds or toilet
facilities are temporary buildings, and
(b) specify a removal date that is no
later than one year after the date of issue of the complying development
certificate.
