Development of certain land zoned Special Uses “A”
16A Development of certain land zoned Special Uses “A”
(1) In this clause,
"recreation area" means: (a) a children’s playground,
(b) an area for
sporting activities or sporting facilities,
(c) an area used by the Council
to provide recreational facilities for the physical, cultural or intellectual
welfare of the community, or
(d) an area used by a body of persons associated
for the purposes of the physical, cultural or intellectual welfare of the
community to provide recreational facilities for those purposes,
but does not
include a racecourse or a showground.
(2) Nothing in this plan prevents a
person, with the consent of the Council, from carrying out development for the
purposes of a recreation area on land: (a) within Zone No 5 (a), and
(b) on
which development may be carried out for the particular purpose of aquatic
recreation (as indicated on the map).
(3) Before consenting to development on
any land referred to in subclause (2), the Council is to consider: (a) the
need for the development on that land,
(b) the impact of the proposed
development on the existing or likely future use of the land,
(c) the need to
retain the land for its existing or likely future use, and
(d) the effect of
the proposed development on the capacity of the land to act as a floodway.
