Outcomes for the Peripheral Area
9A Outcomes for the Peripheral Area
(1) Definition In this clause,
"Peripheral Area" means the land shown edged heavy black on the map marked “
Leeton Local Environmental Plan No 33 ”.
(2) Consent required for buildings
and subdivision works Development for the purpose of buildings and subdivision
works may be carried out within the Peripheral Area only with the consent of
the council, despite anything else in this plan.
(3) Restriction on granting
consent The council must not grant consent for any development within the
Peripheral Area unless it is satisfied that carrying out the proposed
development will be consistent with achieving the following outcomes: (a) The
boundary of the Peripheral Area is to be the boundary for the expansion of the
towns of Leeton and Yanco.
(b) If the proposed development will require the
provision of services to any land, the land will be connected to services that
the council considers appropriate for the proposed land use and that are
provided without cost to the council.
(c) If the proposed development will
create a land use conflict, the conflict will be reduced by the provision of
adequate buffers within the Peripheral Area.
(d) If the proposed development
will (or, in the opinion of the council, will be likely to) result in
buildings on an allotment having an area greater than 1 800 square metres,
building envelopes will be established to the satisfaction of the council, so
that future subdivision may be allowed where the council considers it
appropriate.
