Temporary use of land
59 Temporary use of land
(1) Notwithstanding any other provision of this plan, the Council may grant
consent to the temporary use of any land for any purpose (not being designated
development or development prohibited by the provisions of any other
environmental planning instrument applying to the land) for a maximum period
of 28 days (whether or not the days are consecutive) in any one year.
(2) In
determining whether to grant consent as referred to in subclause (1), the
Council shall take into consideration: (a) the protection of the environment
and the amenity of the locality during and immediately after the carrying out
of the proposed use, and
(b) whether appropriate arrangements will be made
for the provision of utility services, vehicular and pedestrian access,
parking and restoration of the site to the condition prevailing immediately
before the carrying out of the proposed use, and
(c) whether the period for
the carrying out of the proposed use is reasonable in the circumstances or
whether a lesser period would be more appropriate.
