Exemption condition-possession or supply of illegal substances
5 Exemption condition-possession or supply of illegal substances
(1) The object of this clause is to impose a condition, pursuant to section 9
of the Act, on the provision of health care services by a visiting health
professional.
(2) A visiting health professional must not, in the course of
providing health care services, possess or supply any substance that cannot be
possessed or supplied by any local health professional under the
Drug Misuse and Trafficking Act 1985 or the Poisons and Therapeutic Goods Act
1966 .
(3) A
"local health professional" is a person who is registered under a Health
Registration Act and is not a visiting health professional.
Note: Section 9
of the Act allows the regulations to make provision for or with respect to
conditions to be imposed on the provision of health care services by visiting
health professionals. A visiting health professional is authorised to provide
health care services under the Act only while the visiting health professional
is complying with the conditions of that authorisation (see section 8 of
the Act).
