Development for certain additional purposes
49 Development for certain additional purposes
(1) Nothing in this plan prevents a person, with the consent of the Council,
from carrying out development on land referred to in Schedule 7 for a purpose
specified in relation to that land in that Schedule, subject to such
conditions, if any, as are so specified.
(2) Subclause (1) does not affect
the application, to or in respect of development to which that subclause
applies, of such of the provisions of this plan as are not inconsistent with
that subclause or with a consent granted by the Council in respect of the
development.
(3) If a condition referred to in subclause (1) requires consent
to be granted within a specified period from the date of gazettal of an
environmental planning instrument, the Council may not grant consent after the
expiration of that period (or after such later date as the Minister may,
before expiration of that period, notify by order published in the Gazette).
(4) Nothing in subclause (3) prevents the Council from granting consent to the
carrying out of alterations or extensions to, or the rebuilding of, a building
or place being used for a purpose for which consent has been granted in
accordance with subclause (1).
