Refusal of insurance claims
64 Refusal of insurance claims
(1) For the purposes of making an appeal against a decision of an insurer, an
insurance claim is taken to have been refused if written notice of the
insurer’s decision is not given to the beneficiary within 45 days of the
lodging of the claim with the insurer or within such further time as may be
agreed between the beneficiary and the insurer.
(2) This clause does not
apply to an insurance claim made in relation to an insurance contract entered
into on or after 1 September 2005.
