HOME BUILDING REGULATION 2004 - REG 52
Definitions
52 Definitions
(1) In this Part:
"beneficiary" means a person entitled to claim a benefit provided under an
insurance contract.
"common property" means: (a) common property within the meaning of the Strata
Schemes (Freehold Development) Act 1973 or the Strata
Schemes (Leasehold Development) Act 1986 , or
(b) association property within
the meaning of the Community Land Development Act 1989 .
"contractor" means a person required by section 92 of the Act not to do
residential building work under a contract unless an insurance contract is in
force in relation to the work.
"insolvent" means: (a) in relation to an individual, that the individual is
insolvent under administration (within the meaning of the Corporations Act
2001 of the Commonwealth), or
(b) in relation to a corporation, that the
corporation is an externally-administered body corporate (within the meaning
of the Corporations Act 2001 of the Commonwealth).
"insurance contract" means a contract of insurance required to be entered into
under Part 6 of the Act.
"insurer" means the issuer or provider of an insurance contract.
"owner-builder work" means owner-builder work within the meaning of Division 3
of Part 3 of the Act that involves: (a) the construction of a dwelling, or
(b) the alteration of, or additions to, a dwelling, or
(c) the construction
of an inground swimming pool.
"principal certifying authority" has the same meaning as it has in the
Environmental Planning and Assessment Act 1979 .
(2) In this Part, work is
taken not to be completed even though it has not commenced.
(3) A reference
in this Part to the disappearance of a contractor or owner-builder includes a
reference to the fact that, after due search and inquiry, the contractor or
owner-builder cannot be found.
