New South Wales Consolidated RegulationsPart 2 of the Licensing and Registration (Uniform Procedures) Act 2002 is modified in the following manner:
(a) sections 9 and 10 do not apply in relation to an owner-builder permit,
(b) section 14 (1) is taken to read as follows:(1) The relevant licensing authority may serve notice on an applicant requiring the applicant:(a) to provide:(i) such information further to the original information contained in the application, and(ii) such documentary or other evidence in support of the original or further information,as the authority may require to enable it to deal with the application, or(b) to have his or her photograph taken by the licensing authority, or to provide a photograph in a form specified by the authority.
(c) section 21 is taken to include the following subsection after section 21 (2):(2A) Except for the purposes of any proceedings for an offence or relating to a complaint under Part 4 of the Home Building Act 1989 , an authority that is the subject of an application for restoration (a "restoration application") that has been duly made is to be taken to have continued in force from the time the authority expired until one of the following occurs:(a) the authority is renewed by the Director-General, or(b) if the Director-General rejects the application and:(i) an application for a review of the rejection is not lodged with the Administrative Decisions Tribunal within 30 days after that rejection-the expiry of that 30 day period, or(ii) an application for the review of the rejection is lodged with the Administrative Decisions Tribunal within 30 days after that rejection-the application is decided or withdrawn, or(c) the restoration application is withdrawn.
(d) section 21 is taken to include the following subsection after section 21 (8):(9) Nothing in this section prevents the suspension of a contractor licence (within the meaning of the Home Building Act 1989 ).
