GAS SUPPLY (NATURAL GAS RETAIL COMPETITION) REGULATION 2001 - REG 37

37 No access to meter
(1) If a supplier under a customer supply contract with a small retail
customer, or a person on behalf of the supplier, is unable to obtain access to
metering equipment for the purpose of determining the quantity of gas
supplied, the supplier must ask the customer to elect: (a) to pay an amount
estimated in accordance with this Division and to have that amount reconciled
in the next bill, or
(b) to pay an amount based on a determination by the
supplier after obtaining access to the metering equipment.
(2) Nothing in
this clause prevents the supplier and the customer from agreeing that the
customer is to pay an amount based on information provided by the customer as
to the amount registered by the meter in respect of that period.
(3) This
clause does not apply to a negotiated customer supply contract if charges for
the supply of gas under the contract are not based on the customer’s gas
consumption.
