Correction where customer overcharged
27 Correction where customer overcharged
(1) If on a review of a complaint by a small retail customer, or at any other
time, the supplier determines that the customer has been charged more than the
amount that should have been charged under the customer supply contract
concerned, and the amount overcharged exceeds $25, the supplier must: (a)
inform the customer not later than 10 business days after becoming aware of
the overcharging, and
(b) reimburse the amount overcharged to the customer in
accordance with the customer’s instructions or if, no instructions are
given, credit the amount to the customer in the next bill issued to the
customer, and
(c) pay interest on any overcharged amount paid by the customer
at the rate prescribed under section 101 of the Civil Procedure Act 2005 for
payment of interest on a judgment debt.
(2) If any overcharged amount paid by
the customer does not exceed $25, the supplier must: (a) credit the amount to
the customer in the next bill issued to the customer, and
(b) credit interest
on that amount at the rate prescribed under section 101 of the
Civil Procedure Act 2005 for payment of interest on a judgment debt.
