51 What matters must the Council consider when consenting to development
within the 2t Residential-Tourism zone that is not defined for the purposes of
this plan?
(1) This clause applies to development for the purpose of a building, work,
place or land use permissible with consent within the 2t Residential-Tourism
zone, but that is not defined by the dictionary.
(2) The Council may grant
consent to the carrying out of development to which this clause applies if,
and only if, in the opinion of the Council: (a) the proposed development would
not undermine the objectives of this plan and granting consent would not set a
precedent for subsequent development that would cumulatively be inconsistent
with the objectives of this plan, and
(b) the development would be compatible
with the objectives of the zone in which it is proposed, the character of the
land on which it is proposed, adjoining land uses and the amenity of the
locality enjoyed by its residents.
(3) The Council must not grant consent for
development pursuant to this clause unless it has considered a report on the
likely effect of the proposed development that addresses the following: (a)
any social, economic and environmental impacts on the community,
(b) any
transformation of the character and amenity of the locality,
(c) any
environmental impact on the ecosystem of the locality,
(d) any reduction of
the aesthetic, recreational, scientific or other environmental quality or
value of the locality,
(e) any effect on items, structures and places having
heritage significance or other special value for present or future
generations,
(f) any long-term effects on the environment,
(g) any
endangering of any species of animal, plant or other form of life,
(h) any
degradation of the quality of the environment,
(i) any risk of safety to the
environment,
(j) any environmental problems associated with the disposal of
waste,
(k) any cumulative environmental effect with other existing or likely
future development or activities.
(4) Development for which consent is sought
pursuant to this clause must be advertised as if it were designated
development.
